These Terms of Service ("Terms") apply to everyone who uses AtexStudio: sellers who list and sell on the AtexStudio marketplace ("Sellers") and buyers who order from them ("Customers"). By creating an account, listing on the marketplace or placing an order you agree to them. If you use AtexStudio for a business, you agree on its behalf.
1. What AtexStudio is
AtexStudio is an online marketplace for freelancers and digital product sellers. Independent Sellers list digital products and online services on the marketplace at atexstudio.com; each Seller also has a storefront on an AtexStudio address (name.atexstudio.com) where Customers place and pay for their orders. AtexStudio operates the marketplace and the storefronts, delivers files, carries messages and keeps a tracked record of every order. AtexStudio is not a party to the sale between a Seller and a Customer.
AtexStudio never receives, holds, converts or transmits Seller or Customer funds. Every sale is processed by our payment partner (see section 4) on the Seller's own connected account; funds are held by the payment partner and its licensed financial partners and paid out, at the Seller's request, to the payout method they register.
2. Accounts
- You must be at least 18 and able to form a binding contract.
- Give accurate information and keep it current. Your account email is fixed; to change it, contact support.
- Keep your sign-in details safe. You are responsible for activity on your account. We recommend turning on two-factor authentication.
- We may refuse, suspend or close accounts that break these Terms, put others at risk, or that our payment partner can't support.
3. Sellers
3.1 Verification
Selling on AtexStudio requires a connected account with our payment partner (see section 4). Before you can take payments, you (and, for businesses, your company) must pass identity checks run by our payment partner. The partner may ask for more information at any time; payments or payouts can be paused until requests are answered.
3.2 Marketplace listings
- Once you are verified, your published products and services are listed on the marketplace, each in the platform category you choose, together with a profile page for your store. Listing is part of selling on AtexStudio.
- Choose the category that honestly describes each listing. We may move a listing to a better category, or hide a listing or store from the marketplace, where it breaks these Terms or our Acceptable Use Policy, or to protect Customers.
- Marketplace pages show your store name, logo, description, listings, prices and verified-buyer reviews. Orders from the marketplace are always placed on your storefront.
3.3 Your store and products
- You are the merchant for every sale in your store. You are responsible for your products, descriptions, prices, delivery, customer support, the refunds you agree to and any taxes due on your sales.
- You may only sell digital products and services you have the right to sell, as described in our Acceptable Use Policy.
- Describe products honestly, including what is included, how it is delivered and any limits on use.
- Deliver service orders within the time you promise, and respond to customer messages promptly.
- Your store includes default Terms, Refund and Privacy pages you can replace with your own. Whatever you publish must be accurate and lawful, and it binds your sales.
3.4 Fees
Fees are published on our pricing page and shown on every order. The platform fee is deducted from each successful sale. Customers pay a service fee shown at checkout. Payout fees are set by the payment partner and shown before you withdraw. We will tell you by email before fees change; orders keep the rates in force when they were placed.
3.5 Refunds, disputes and reserves
Refunds are paid from your balance and fees on the original sale are not returned. If a Customer's bank disputes a payment, the disputed amount and any dispute fee may be held or deducted by the payment partner. AtexStudio attaches the order's delivery record to the dispute for you to review and send. The payment partner may hold reserves or delay payouts where it considers there is risk.
3.6 Delivery records
AtexStudio records order events, downloads and messages automatically. These records can't be edited by Sellers. You may share them through tracking links; you are responsible for sharing customer details only where you have a lawful reason to.
4. Payment partners
AtexStudio works with the following payment processing partners:
- Whop
- PingPongX
Which partner serves a Seller's account may vary by the region of the account holder. When a Seller signs up, AtexStudio onboards them to that partner: it opens the Seller's own connected account under AtexStudio's platform, runs the identity (KYC) verification itself, processes the payments made on the Seller's checkout pages, holds the Seller's balance with its licensed financial partners and sends the Seller's payouts. Every checkout page on an AtexStudio store is integrated with that Seller's connected account, and payments settle directly into it.
Selling on AtexStudio requires a connected account with our payment partner, which we open and manage on the Seller's instruction. The payment partner's own terms, and those of its financial partners, apply to payment processing, custody, identity verification and payouts, in addition to these Terms. Where a change of payment partner materially affects the operation of a Seller's account, we will notify the Seller.
5. Customers
- Every listing on the marketplace is offered by an independent Seller who is responsible for its products, delivery and refunds. Choosing "Buy now" takes you to that Seller's storefront, where you place your order. Your purchase contract is with the Seller.
- The price, service fee and total are shown before you pay. Payments are processed by our partner payment processor.
- Downloads are available from the confirmation page, your receipt and your account. Links expire for your security; fresh ones are always in your account.
- Refunds follow the store's refund policy. If a store doesn't resolve an issue, contact [email protected].
- Reviews must be honest, about the product, and free of abuse or personal information.
6. Content and licences
Sellers keep ownership of their content. You grant AtexStudio a licence to host, display, list, promote, deliver and process it as needed to run your store, the marketplace and the platform. Customers receive the licence to use a product that the Seller describes; unless stated otherwise, it is personal and non-transferable.
7. Suspension and termination
We may suspend a store or account, hide or remove listings, products or reviews, or pause access where we reasonably believe these Terms or the law are broken, where our payment partner requires it, or to protect Customers. Where possible we'll tell you why and how to fix it. You can close your account at any time; obligations for past orders, refunds and disputes continue.
8. Availability and liability
We work to keep AtexStudio available and secure but provide it "as is", without guarantees of uninterrupted service. To the extent the law allows, we are not liable for indirect or consequential losses, and our total liability for any claim is limited to the fees you paid us in the three months before it. Nothing in these Terms limits rights you have under consumer law that can't be excluded.
9. Changes
We may update these Terms. We'll email Sellers about significant changes before they take effect. Continuing to use AtexStudio after a change means you accept it.
